1. Orders

1.1 All orders for Goods and/or Services constitute an offer by the Buyer to purchase Goods and/or Services in accordance with these Terms and Conditions and are subject to acceptance by the Supplier. The Supplier reserves the right to refuse any order at its discretion.

1.2 If Goods ordered by the Buyer are unavailable, the Buyer will be notified and offered the option to either wait for the Goods to become available or cancel the order for a full refund within 28 days.

1.3 Promotional and discount codes are for single use only, where applicable, and cannot be combined with other offers. The Supplier reserves the right to withdraw, withhold, or cancel any promotional code used more than once or deemed to be in breach of the fair usage policy.

2. Price and Payment

2.1 The price of Goods and/or Services will be as displayed on the website.

2.2 The Buyer’s shopping cart will display the total purchase price, including applicable shipping fees, before order confirmation.

2.3 Upon order placement, the Supplier will provide the Buyer with an order confirmation detailing the Goods and/or Services, price, and the Buyer’s right to cancel (if applicable).

2.4 Payment for the order, including any delivery fees, is due at the time of ordering.

2.5 For pre-ordered items, full payment, including all applicable delivery fees, is required at the time of ordering, even though the items will not be shipped until the pre-arranged date.

2.6 Any late, rejected, or declined payment will be considered overdue. The Supplier reserves the right to immediately cease or suspend the provision of Services or delivery of Goods until full payment is received.

3. Supplier Rights

3.1 The Supplier reserves the right to modify prices on the website at any time. Prices are not guaranteed and are subject to change. The Supplier will make every effort to ensure prices are accurate at the time of order placement.

3.2 The Supplier may remove any Goods and/or Services from the website at any time.

3.3 The Supplier may withdraw or terminate any offer code or promotion at any time.

3.4 The Supplier shall not be liable to any party for any decision not to process an order or for the removal of any Goods or Services from the website.

4. Delivery

4.1 If a specified delivery date cannot be met, the Buyer will be notified and given the option to accept a revised delivery date or receive a full refund.

4.2 While the Supplier will make every effort to deliver Goods by any agreed-upon date, time shall not be of the essence for delivery. The Supplier shall not be liable for any loss, costs, damages, or expenses incurred by the Buyer or any third party due to any failure to meet an estimated delivery date.

4.3 Goods will be delivered to the address specified by the Buyer in the order. The Buyer is responsible for ensuring adequate arrangements are in place to accept delivery of the Goods.

4.4 Risk in the Goods passes to the Buyer upon delivery or attempted delivery.

4.5 Title to the Goods shall not pass to the Buyer until full payment has been received.

4.6 If the Buyer refuses delivery, the Goods will be returned to the Supplier, and the Buyer will be responsible for the return delivery fee.

5. Cancellation and Returns

5.1 Due to the perishable nature of our products, orders cannot be cancelled once placed. Refunds are at the management’s discretion. In the event of product dissatisfaction, please contact us immediately. Do not return items without prior authorization.

5.2 If the Buyer reports a fault or damage, the Goods may need to be returned to the Supplier within 7 days of receipt, or by the product’s use-by or best-before date, whichever is sooner. In such cases, the Buyer will be entitled to a replacement or a full refund.

5.3 Returned Goods must be accompanied by the original packaging and proof of purchase clearly displaying the order number provided by the Supplier.

5.4 Refunds and exchanges are not available for perishable, frozen, and fresh food items.

5.5 To be eligible for return, items must be unopened, unused, and in their original packaging.

5.6 Do not return any Goods to the manufacturer.

5.7 Upon receipt and inspection of returned items, the Buyer will be notified by email regarding the status of their refund. If approved, the refund will be processed, and a credit will be automatically applied to the original payment method within a specified number of days.  

 

5.8 If the refund does not appear in the Buyer’s account, they should first check their bank account, then contact their credit card provider and bank, as processing times may vary.

5.9 Claims for missing items must be made within 3 days of the expected delivery date. After this period, such claims cannot be processed. Verified claims will be resolved by either resending the missing item or issuing a refund, as per the Buyer’s preference.

6. Limitation of Liability

6.1 The Supplier’s liability for any breach of these Terms and Conditions is limited to damages not exceeding the cost of the Goods and/or Services, except where otherwise implied by law for Consumers. The Supplier shall not be liable for any indirect, incidental, or consequential loss or damage.

6.2 Nothing in these Terms and Conditions shall limit or exclude the Supplier’s liability for death or personal injury caused by the negligence of the Supplier, its agents, or employees.

7. Waiver

No waiver by the Supplier, express or implied, of any breach of these Terms and Conditions shall prejudice the Supplier’s right to enforce such terms in the future.

8. Force Majeure

The Supplier shall not be liable for any delay or failure to perform its obligations under these Terms and Conditions due to events or circumstances beyond its reasonable control, including but not limited to acts of God, strikes, lockouts, accidents, war, fire, failure of communication or computer systems, plant or machinery breakdown, and shortages or unavailability of raw materials. In such circumstances, the Supplier shall be entitled to a reasonable extension of time to fulfill its obligations.

9. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.  

 

10. Discount Voucher Codes

Discount Voucher Codes may be subject to specific terms and conditions, which will be communicated upon code release and, if issued physically, in writing. If a code is not working, please contact customer service for assistance. Refunds are applicable only to regular-priced items; sale items are non-refundable.

11. Substitution of Products

The Supplier reserves the right, in exceptional circumstances, to substitute products within a product pack or offer. Items will only be replaced if defective or damaged. To exchange a defective or damaged item, please contact us at sales@abamfoods.shop.
